Photo of the Month Presented by Northwell
The following terms and conditions (collectively, the "Official Rules") shall apply to the Twin Rinks Acquisition Company LLC’s “Photo of the Month Presented by Northwell” sweepstakes (the "Sweepstakes").
Eligibility: VOID WHERE PROHIBITED. The Sweepstakes is open to legal residents of the United States (excluding residents of Puerto Rico, U.S. Virgin Islands, Guam and other United States territories) who are at least 18 years of age at the time of entry. All eligibility is further subject to all federal, state, and local laws and regulations. All entries submitted are the property of Twin Rinks Acquisition Company LLC (the "Sponsor"). No purchase necessary to enter or win the Sweepstakes. A purchase will not increase or impact your chances of winning. Employees of the Sponsor, its affiliates, and the immediate families and household members of each are not eligible to win.
How to Participate: The Sweepstakes period begins at 12:01 p.m. Eastern Time ("ET") on January 20, 2023 and ends at 11:59 p.m. ET on December 31, 2023 (the "Sweepstakes Period"). During the Sweepstakes Period, you may enter the Sweepstakes by taking your photograph (the “Content”) in front of the Northwell step and repeat banner in the lobby of Northwell Health Ice Center located at 200 Merrick Avenue, East Meadow, New York 11554, and sending the Content to the Sponsor’s email address at photos@northwellhealthicecenter.com. Only original Content is eligible to win the Sweepstakes. Each entrant must be the original creator of his/her submitted Content, and Sponsor reserves the right to validate originality. Each entrant represents and warrants that entrant has all rights and permissions (including, without limitation, the permissions of any third parties appearing in the Content) necessary to: (a) submit entrant’s Content to Sponsor in connection to this Sweepstakes, and (b) to grant all rights to the Content to Sponsor as contemplated herein (including, without limitation, on behalf of any third parties appearing in the Content).
There shall be twelve (12) unique entry periods throughout the Sweepstakes Period (each, an “Entry Period”; together the “Entry Periods”). Only one (1) entry per person is permitted during each Entry Period. The Entry Periods shall be as follows:
By submitting any entry, you agree to be bound by these Official Rules. Entries that do not comply with these Official Rules will be disqualified.
One (1) winner will be selected in a random drawing containing all eligible entries received during each Entry Period (i.e., twelve (12) winners will be selected in total across the Entry Periods (each, a “Winner”; together, the “Winners”); one (1) Winner per Entry Period)). Drawing will take place on the first day of each month after the applicable Entry Period (e.g., the drawing for Entry Period 1 will take place on February 1, 2023). Sponsor's decision is based on its sole discretion and interpretation of these Official Rules and is final and binding in all respects. Each Winner will receive one (1) one-hundred-dollar gift card redeemable at the Islanders Pro Shop at Northwell Health Ice Center (each, a “Prize”). Approximate retail value of each Prize: $100.00. Odds of winning a Prize depend on the number of eligible entries received during the applicable Entry Period. For the avoidance of doubt, each Prize shall be awarded only to the one (1) Winner that owns the email address used to enter the Sweepstakes.
The Winner will be notified by 11:00 a.m. ET on the first day of the month after the applicable Entry Period (e.g., the Winner for Entry Period 1 will be notified on February 1, 2023 by 11:00 a.m. ET). Each Winner agrees to be notified by Sponsor by email. If any Winner is unreachable for five (5) days from Sponsor’s notification to Winner (e.g., if the Winner for Entry Period 1 does not respond by February 6, 2023), or if a Winner is unavailable for the Prize, an alternate winner will be randomly selected by the Sponsor. Each Prize is nontransferable. Winners are not eligible to win a second time.
By claiming a Prize, each Winner authorizes the use, without additional compensation, of Winner’s name and/or Content and/or likeness and/or voice/photograph and/or municipality of residence for promotion and/or advertising purposes in any manner and in any medium which the Sponsor may deem appropriate. Winners and all entrants, as a condition of entry into the Sweepstakes, agree to release Sponsor, New York Islanders Hockey Club, L.P., the National Hockey League, Northwell Health, Inc., Nassau County, Twitter, Inc. (“Twitter”), Instagram, LLC (“Instagram”), and each of their respective affiliates (each, a “Released Party”; collectively, the “Released Parties”) from and against any and all liability, claims or actions of any kind whatsoever for injuries (including as a result of the novel COVID-19 virus), damages, or losses to persons or property which may be sustained in connection with participating in any aspect of the Sweepstakes, the receipt, ownership or use of any Prize awarded, or any typographical or other error in these Official Rules.
The Sweepstakes is subject to all federal, state, and local laws. The Sponsor reserves the right to withdraw, terminate or modify the Sweepstakes at any time without prior notice. Any federal, state and local taxes and expenses relating to the acceptance and use of a Prize are the sole responsibility of each Winner. Void where prohibited by law.
The Sponsor is not responsible for technical, hardware, software or telephone malfunctions of any kind, lost or unavailable network connections, or failed, incorrect, incomplete, inaccurate, garbled or delayed electronic communications caused by the user or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any human error which may occur in the processing of the entries in the Sweepstakes or for any liability for damage to any computer system resulting from participation in, accessing or downloading information in connection with the Sweepstakes. The Sponsor reserves the right in its sole discretion to disqualify any individual that tampers or attempts to tamper with the entry process or the operation of the Sweepstakes; violates the Official Rules; or acts in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
The Sweepstakes is in no way sponsored, endorsed, administered by, or associated with, Instagram or Twitter.
Each entrant hereby acknowledges and agrees that all Content submitted in connection to this Sweepstakes shall be deemed a ‘work made for hire’, as defined in the United States Copyright Act. Each entrant hereby agrees that Sponsor shall be the exclusive owner of such Content and all rights therein. Sponsor’s ownership includes without limitation the rights to: (i) exhibit, broadcast, use, reproduce, distribute, perform, and license others to use all or any part of the Content; (ii) edit or modify the Content in any manner, or combine same with any other materials; and (iii) use and license third parties to use the Content and/or any portion thereof in any manner of exploitation. Each entrant represents and warrants that their submitted Content: (a) does not infringe on any copyright or proprietary rights of others; (b) is not libelous or obscene; and (c) that the Content does not violate the right of privacy or publicity, or any other rights of any person, firm, or entity.
Each entrant shall indemnify the Released Parties from and against any and all losses, costs, damages, injuries, awards, judgments and liabilities, including but not limited to legal and professional fees, costs, and expenses, incurred by any Released Party as a result of any claim, suit, proceeding or cause of action asserted against a Released Party by a third party (“Claim”) and shall defend the Released Party against any such Claims arising from: (i) any copyright, patent and/or trademark infringement, unlawful disclosure or use or misappropriation of a trade secret or other intellectual property right owing to the Released Party's use of the Content submitted by such entrant; or (ii) any breach of these Official Rules by such entrant.
